BESHU is operated by The Trustee for AP Fitz Family Trust (ABN 90 972 637 818), trading as BESHU ("we", "us", "our"). We respect your privacy and are committed to protecting your personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

This Privacy Policy explains how we collect, use, store, and protect your personal information when you interact with our website, our paid programs, or any other BESHU services.

1. What We Collect

We collect personal information that you provide directly to us, including:

• Name and contact details (email, phone, postal address where relevant)
• Payment information for paid programs (processed via secure third-party providers)
• Information you share when booking sessions, joining programs, or contacting us
• Survey responses, feedback, and program engagement data
• Communications you send us (emails, form submissions, voice notes)

We also automatically collect:

• Website usage data (pages visited, time spent, referring URLs)
• Device and browser information (IP address, browser type, operating system)
• Cookies and similar tracking technologies (see Section 7 below)

2. How We Use Your Information

We use your personal information to:

• Deliver the services you've signed up for (mentoring sessions, programs, downloads)
• Process payments and send receipts
• Send program updates, check-ins, and resources you've subscribed to
• Respond to your enquiries and provide customer support
• Send you marketing communications (only if you've subscribed - you can unsubscribe at any time)
• Improve our website, services, and content based on aggregated usage data
• Comply with legal obligations and regulatory requirements

3. Sensitive Information

If you share sensitive personal information with us during mentoring sessions, forms, or programs (e.g. mental health history, lived experiences, personal struggles), we treat this with the strictest confidentiality. We do not share this information with third parties unless required by law (e.g. duty of care for safety) or with your explicit consent.

Important: BESHU is not a clinical mental health service. We are not bound by the same confidentiality obligations as registered psychologists or medical practitioners under AHPRA. We follow industry best practice for non-clinical mentoring and treat your information with care and discretion.

4. Storing + Securing Your Information

We use industry-standard security measures to protect your personal information:

• Encrypted data transmission (HTTPS / SSL)
• Secure third-party platforms with their own privacy compliance
• Limited access to personal information (only Lou and authorised assistants)
• Regular security reviews of our tools and processes

Payment information: We do not store credit card details on our servers. All payments are processed by Stripe, which is PCI-DSS compliant.

Data retention: We retain personal information for as long as needed to provide the service, plus up to 7 years for tax and legal compliance. You can request earlier deletion at any time (see Section 9).

5. Who We Share Information With

We do not sell, rent, or trade your personal information. We share it only with trusted service providers who help us run BESHU:

• TekMatix / GoHighLevel - CRM, email marketing, course platform (Privacy Policy)
• Stripe - Payment processing (Privacy Policy)
• Google Workspace - Email, Drive, Calendar, Analytics (Privacy Policy)
• Buzzsprout - Podcast hosting (Privacy Policy)
• Zoom - Video calls for 1:1 sessions (Privacy Policy)
• Meta (Facebook + Instagram) - Social media + advertising (Privacy Policy)
• Apple Podcasts + Spotify - Podcast distribution
• Netlify - Web hosting for select tools

Some service providers may be located overseas (primarily USA). These providers are required to meet privacy standards consistent with Australian law where possible. By using our services, you consent to this overseas data processing.

6. Legal Disclosures

We may disclose your personal information when required by law:

• To comply with court orders, subpoenas, or law enforcement requests
• To protect the rights, property, or safety of BESHU, our clients, or third parties
• In response to a duty of care if we genuinely believe someone is at risk of harm
• In the event of a business sale, merger, or transfer (under confidentiality agreements)

7. Cookies + Website Tracking

Our website uses cookies and similar technologies to:

• Analyse website traffic and improve user experience (Google Analytics)
• Personalise content and remember preferences
• Serve relevant advertising through Meta (Facebook) Pixel and Google Ads

8. Direct Marketing

We use AI tools (including Claude by Anthropic) to support our business operations. We believe in being upfront about this.

What AI IS used for:

• Drafting and editing content (blog posts, emails, social media, program materials)
• Business planning, organisation, and administrative support
• Marketing automation through TekMatix / GoHighLevel
• Website design and development support

What AI is NOT used for:

• Clinical decision-making about you
• Replacing Lou's voice or judgement in your 1:1 sessions
• Processing your personal mental health conversations
• Making automated decisions that significantly affect you

Your 1:1 sessions are conducted personally by Lou. All content sent to you (emails, programs, resources) is human-reviewed before publishing.

14. Transcription + Recording Tools

To deliver personalised support efficiently and consistently, we use transcription tools as part of our business workflow. We believe in being upfront about this too.

How transcription is used:

• Transcribing Lou's own voice memos for content creation, business planning, and program development
• Voxer voice messaging for Premium 1:1 All-In clients (audio messages between Lou and client only)
• Session note support, podcast pre-production, and similar operational tasks
• Transcribing client voice messages where the client has chosen to send audio (e.g. Voxer, voice notes via email) - this is treated as part of the communication you've initiated with us

Australian best practice standards:

We only use transcription tools that meet the following standards, aligned with Australian best practice:

• Encryption of data in transit (TLS) and at rest
• Aligned with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs)
• Aligned with the OAIC's Guide to Securing Personal Information
• Aligned with the Australian Cyber Security Centre's Essential Eight guidance where applicable
• No use of free or consumer-grade tools for client data

Your rights regarding transcription:

• You may decline to be recorded or transcribed in any 1:1 session
• You may request access to any transcripts of your sessions
• You may request deletion of any session recordings or transcripts
• We will never record, transcribe, or apply AI to a clinical-style client session without your explicit prior consent
